of $65,100 and sale of this parcel to the municipality at the appraised value be  
approved. The motion carried by a voice vote.  
D. Such Other Business as Allowed by Law  
Erickson inquired about the status of 305 S Bedford (item C-7, Act-124).  
Gallagher explained that the City had approved $200,000 for purchase at the  
Amount Due prior to US Supreme Court decision Tyler-v-Hennepin County. Per  
the Tyler court decision, any difference between the Amount Due and the Fair  
Market Value goes back to the former owner to prevent a "takings" by the  
County. The Tax Deed Subcommittee just approved item C-7 to comply with the  
Tyler decision. The County is currently awaiting City approval to purchase under  
the new Tyler decision requirement of Fair Market Value rather than the Amount  
Due. If the City decides not to purchase, an appraiser will provide a professional  
appraisal, and the Tax Deed Subcommittee will get to approve sale at a public  
auction Spring 2024.
