DEFENDANTS FOUND NOT COMPETENT TO STAND TRIAL DATA

Presentation regarding defendants found not competent to stand trial and data on the
frequency of cases and defendants from 2019 to 2021. Several defendants have multiple
cases. Competency hearings must occur when there is an indication that the defendant
may not be competent. There are three possible outcomes of competency hearing: 1) not
competent but likely to become competent with treatment; 2) not competent and not
likely to become competent with treatment; and 3) competent.
Discussion ensued. Future research needs to examine differences (if any) between local
and state/national trends. Discussion of who can raise competency issues.

1. 2022 Budget Updates
Information presented by subcommittee members, representing their respective
agencies.
Department of Human Services: The crisis triage center was funded - $10 million for
space and $1.5 million for operations. The behavioral health resource center (BRHC) has
grown and expanded, and will soon have a marketing campaign. CCS programs continue
to grow, increased staff position. There is a focus on having a full connection and
continuum overseen by one body for behavioral health services.
There are new funds for victim/witness behavioral health services. The pretrial services
director was also funded, which will increase services through pretrial services.
The CARES non-law enforcement crisis response team seems promising from early pilot
data, but it is too early to fully determine.
2. Peer Support Discussion and Further Work on Intercept 2
Presented by Moffit, James Morgan, Janie Ocejo
Discussion by certified peer specialists about their work in the criminal justice system.
Discussion of barriers to peer support in booking, pre-trial, and trial. There is a need for
improved information-sharing, in addition to a trauma-informed, gender-responsive
approach to peer support in criminal justice.
Discussion about additional points that peer support can be added to the criminal justice
system within each intercept. Subcommittee needs to do additional research before
implementing peer support, and will begin to move concrete actions in January 2022.
