MINUTES OF THE APRIL 13, 2022 CRIMINAL JUSTICE COUNCIL -  
PRE-TRIAL SERVICES SUBCOMMITTEE

1. PSA Legacy Site: Dane County  
Presented by Clark-Bernhardt  
Review of presentation regarding Dane County’s history of innovation in pretrial and  
current status as a PSA Legacy Site. As a Legacy Site, Dane County was awarded  
technical support from Advancing Pretrial Policy and Research (APPR). This technical  
assistance will run from July 2022 – January 2023. APPR team members will attend a  
CJC-Pretrial Services subcommittee meeting in the future and will work with the CJC  
Research and Innovation team. They will also collaborate and support the CJC’s work on  
racial equity.

2. Community conversation planning  
Presented by Clark-Bernhardt  
The CJC and this subcommittee are interested in holding another community  
conversation regarding pretrial justice, likely in December. Historically, these meetings  
have been in the evening (about 5pm) and have had a substantial turnout of a couple  
hundred people. These meetings have been virtual recently due to COVID.  
Discussion of timing of the community conversation. Discussion regarding who would  
participate as experts to speak at the meeting, likely one of the leaders on the APPR  
technical assistance team. Discussion of potential funds for community engagement, as  
these funds have been useful for past engagement and feedback from community  
members. Importance of including a court commissioner, since they do the majority of  
the work with setting bail.  
3. Pretrial Office  
Discussion of current barriers in Pretrial Services include technology issues. Some  
devices that are used by pretrial services and DCSO for people on pretrial release are no  
longer functional due to outdated technology. This is a national issue for those working  
with this vendor.  
Discussion of issues with law enforcement agencies, victims, and members of the public  
requesting records from pretrial services, as discussed in April meeting. Discussion with  
criminal circuit judges, discussion of creating similar standard to that of a warrant.  
Discussions of the challenges with pretrial services’ limited hours and capacity, and the  
impact that has on pretrial detention.  
The discussion on this topic will continue when Clerk of Courts Esqueda is available.  
4. Future research  
Presented by Clark-Bernhardt  
Clarification that research requests must go through the full CJC body, and cannot be  
requested directly of the CJC Research & Innovation Team. The team has low capacity  
and needs formal request and direction from the CJC. There are some ongoing large  
projects that require a lot of resources, including the PSA study with Harvard Law  
School’s Access to Justice Lab and the MDRC “dosage” study regarding pretrial  
services.  
Discussion of topics that may require additional research in the future. The Wisconsin  
State Legislature’s proposal about increasing bail and imposing a mandatory $10,000 bail  
for those with prior felonies may require more research as to determine its impact. This  
proposed legislation also has implications for speedy trial requirements. Discussion of  
research request scope and parameters based upon the legislation. The legislation has  
no temporal constraints on prior felonies, meaning that the analysis would need to be  
broad. Interest in looking at what the potential impact of this legislation would be on  
people who are incarcerated pretrial.  
Currently, the Research & Innovation team are onboarding the new CJC Research  
Analyst, Tamarine Cornelius. The team is also working to routinize reports and update  
dashboards consistent with national best practices.

Next Meeting: August 10th at 12:15 pm on Zoom.
